How much can I charge for medical records in Florida?

Although the release of records cannot be conditioned upon payment of a fee for services rendered, the physician can condition such release upon payment of the reasonable costs of reproducing records. Current Florida law permits physicians to charge $1.00 per page for the first 25 pages and 25¢ for each additional page. Fla. Adm. Code Rule 64B8-10.003. Physicians may also charge the reasonable costs for reproducing the records, which can include material and supplies used for duplication as well as staff time and overhead required for the duplication.
However, despite the ability to charge these duplication costs as a practical matter, do not withhold medical information for nonpayment of copying costs, especially if that information is needed to provide care and treatment to the patient. In addition, the record may not be withheld for nonpayment of a medical bill. Such behavior amounts to a failure to comply with good faith discovery requirements.
