Late Operative Report Jeopardized Defense of Lawsuit

The Case

A general surgeon performed a laparoscopic cholecystectomy on a patient. The patient was under general anesthesia for approximately fifty-five minutes  and was discharged home, after recovery, the same day. The surgeon dictated his operative report two days later, documenting the surgery as “markedly uneventful”.
